According to Dextero, Logan Paul and KSI’s Prime Hydration are facing a lawsuit from NASCAR driver Caesar Bacarella, who claims the brand infringed on the trademarks of his nutritional supplement company, Alpha Prime.
Prime Hydration, launched in 2022, has quickly gained popularity around the world as a leading beverage brand. However, on July 30, 2024, Bacarella filed a lawsuit claiming that Prime Hydration’s use of the name “Prime” infringes on his company Alpha Prime’s trademarks.
“This is a civil action for federal trademark infringement (likelihood of confusion) and unfair competition under the Lanham Act, and for trademark infringement of Bacarella’s ALPHA PRIME marks under Florida law.”
The lawsuit accuses Prime Hydration of federal trademark infringement and unfair competition under the Lanham Act, as well as trademark infringement under Florida law. Bacarella argues that Prime Hydration’s marks are confusingly similar to its Alpha Prime and Prime Bites brands, causing actual consumer confusion.
“As described in more detail below, Defendant’s use of PRIME and its derivatives falsely suggests a connection with Bacarella, is confusingly similar to Bacarella’s ALPHA PRIME and PRIME BITES marks, and although ‘PRIME’ has only been on the market for a short time, several instances of actual confusion have been identified.
“The result of these confusingly similar products is a real risk of confusion as to the origin of the products, which is damaging to the reputation and goodwill of the Bacarella brand.”
Bacarella is seeking a court order to prevent Prime Hydration from selling products similar to its own, including the company’s hydration and energy drinks.
In addition to this lawsuit, PRIME is also facing lawsuits from the U.S. Olympic and Paralympic Committee and has also been hit with a $68 million lawsuit. On top of that, Paul could also be involved in the cyberbullying lawsuit against Imane Khelif, so it’s definitely not a good time to be Logan Paul.
